    The Path To Online Gambling

    The legalization of Pennsylvania online gambling started with PA House Bill 271, which was approved by the PA Senate (31-19) on October 25, 2017, and later by the PA House of Representatives (109-72) on October 26, 2017. Governor Tom Wolf signed the bill into law on October 30, 2017.

    Pennsylvania’s House and Senate projected a possible revenue of more than $200 million during this current financial year to be generated via Pennsylvania online casinos. The understanding that the state’s House and Senate operated under was that a limited number of licenses of $10 million would be assigned to interested operators, allowing online slot machines, poker, and table games to be made available to PA residents.

    Pennsylvania passed a bill introducing online gambling and daily fantasy sports to the state on October 30, 2017. The new regulations gave Pennsylvania Online Casinos permission to offer sports betting as soon as the Supreme Court ruled on this matter. Then the Supreme Court declared the federal ban on sports betting unconstitutional on May 14, 2018, overturning the Professional and Amateur Sports Protection Act of 1992.

    This led the Keystone State to become the fourth state to legalize online gambling. The local iGaming industry is expected to surpass that of Nevada, New Jersey, or Delaware due to Pennsylvania’s large population which is almost at 13 million. This is much higher as compared to nine million in NJ or three million in NV. Pennsylvania already has a well-established land-based gambling industry, which is second only to Nevada in its size. In 2017, the combined revenue of all Pennsylvania-based casinos exceeded $3,000,000.

    On that historic day of October 30, 2017, a victory for online gambling was marked. It was on that day that Pennsylvania Governor Tom Wolf signed an omnibus gaming expansion bill, HB 271, into law.

    Inside the provisions of HB 271

    HB 271 is a comprehensive bill that underwent many revisions, with the final version clocking in at over 900 pages. We’ve dissected the bill, and pulled the important parts relevant to those interested in the online gambling provisions.

    • Legalizes online poker, slots, and table games.
    • 12 total licenses available, one for each of the state’s 12 land-based casinos. Each license is broken down into three categories: poker, slots, and table games
    • For the first 90 days of the licensing period, casinos can apply for a collective license covering all three verticals for $10 million.
    • After 90 days, casinos will be allowed to apply for an individual segment of a license for $4 million a pop.
    • After 120 days, any unclaimed licenses can be purchased by qualified entities that aren’t PA land-based casinos. The cost per segment is $4 million.
    • Vendor licenses will cost $1 million.
    • The tax rate on online poker and table games is set at 14% of gross gaming revenue with an additional 2% allocated for a local share assessment. The slot rate is a hefty 52%, also with an added 2% reserved for the local share.

    In addition to online gambling, HB 271 legalizes the following:

    • Video gaming terminals (VGTs) at truck stops
    • Online lottery
    • Daily fantasy sports
    • The construction of up to 10 Category 4 (satellite) casinos.
    • Sports betting, pending the federal law that currently prohibits sports betting in most states, is overturned.

    Statutory and Regulatory Structure

    Location of Operators and Equipment

    The law requires that all interactive gaming devices and associated equipment be located: i) in an interactive gaming restricted area on the premises of the licensed facility; ii) in an interactive gaming restricted area within the geographic limits of the county in Pennsylvania where the licensed facility is located; or iii) in any other area approved by the Board.

    Location of Patrons

    Pennsylvania law states that all wagers made through interactive gaming are deemed to be initiated, received, or otherwise made within the geographic boundaries of the Commonwealth. Wagers are deemed to be placed by the interactive gaming certificate holder.

    Patron Accounts

    Players must first register for and establish an interactive gaming account before playing a game or placing a wager. The interactive gaming account must have the ability to verify the player’s age, identity, and physical address to ensure compliance with the Act. Persons excluded from registering for or maintaining an account include those under the age of 21, those on any self-exclusion or rejection list, and those who are gaming employees, key employees, or principal employees of a slot machine licensee or interactive gaming operator.

    Pennsylvania Sports Betting

    Online sports betting in Pennsylvania became legal as soon as the Supreme Court struck down the PASPA federal ban because local regulators signed the relevant bill in advance of this ruling. Every entity that holds a casino license for slots can apply for a sports wagering certificate, which means that 11 of the 13 local gambling establishments will soon be free to enter this game. Just like with casino games, the costs are expected to be high – a certificate costs $10 million, and the tax rate is 36% on overall revenue.

    None of the eligible casinos have applied for a sports betting certificate so far, but some of them will undoubtedly try to secure a slice of that pie. Since the barrier to entry is very high, we don’t expect any second-league brands. Local casinos will undoubtedly go for the most popular and easily recognizable brands, such as William Hill, Bet365, Winamax, or even BetStars.

    Pennsylvania Daily Fantasy Sports Laws

    According to the new Pennsylvania iGaming bill, DFS contests are supervised by the Pennsylvania Gaming Control Board, but the rules are slightly different than for other forms of internet gambling. Operators aren’t required to have a local partner, a five-year license costs $50,000, and the tax on gross revenue is 15%. Both DraftKings and FanDuel have already been approved, and the list of companies that are currently going through the licensing process is as follows:

    Licensing, Fees, and Taxes

    The state authorized up to 39 licenses for online gaming to be split evenly between online slot machines, online poker, and online banked table games. In the first round of licensing, current land-based slot machine license holders had 90 days to petition for a license to offer all three types of online games for $10 million.
    Between 90 and 120 days after the Pennsylvania Gaming Control Board opened the application, license holders could seek individual gaming licenses for $4 million per category of license (that is, poker, casino, or other table games). After 120 days, any qualified gaming operator could petition for the remaining licenses at a cost of $4 million per category of license. Online gaming operators that are partnered with the license holder must also be licensed at a cost of $1 million.
    Nine casinos filed applications by the deadline of 16 July 2018 (Parx, Mount Airy, Hollywood, Rivers, SugarHouse, Sands, Valley Forge, Harrah's and Stadium). This period was followed by a 30-day period in which Pennsylvania casinos could purchase individual certificates à la carte for $4 million each.
    Pennsylvania has a low corporate income tax of only 36%, has no tax on bets, no sales tax and no VAT. It has political stability, first-class tele-communications agencies and a long-standing financial services industry. In addition, it maintains an attractive environment for international online gaming companies, with a Gaming License recognized by many countries all over the world, and this will make one's establishment a potential goldmine.

    Online Regulation Analysis

    Pennsylvania Gaming Control Board (the Board) has regulatory oversight of interactive gaming in the Commonwealth, including licensing, testing devices, rulemaking, and other related duties.
    An interactive gaming certificate is required to conduct interactive gaming. The Board is permitted to issue a total of 39 interactive gaming certificates, including 13 certificates for peer-to-peer poker games, 13 certificates for non-peer-to-peer simulated slot machines, and 13 certificates for non-peer-to-peer simulated banked table games. The slot machine licensees licensed at the time of the enactment of Pennsylvania’s law authorizing interactive gaming (the Act), were given 120 days to apply for certificates before the application was opened to other applicants.
    After this initial period was reserved for slot machine licensees, the application period was opened to qualified gaming entities (QGE). A QGE is “a gaming entity licensed in any jurisdiction which has satisfied the requirements of this chapter and any other criteria established by the board, including financial and character suitability requirements.”

    The first step is to understand that all gambling winnings are completely taxable and the income must be reported on your tax return. Gambling income includes but isn't limited to winnings from lotteries, raffles, horse races, and casinos. It also includes cash winnings and the fair market value of prizes, such as cars and trips. Depending on the amount of winnings, bettors may receive a W-2G form , which is sent by the payor (casino, pari-mutuel operator, sportsbook, online casino, online sportsbook, etc). The form reveals the amount of winnings and if any tax was withheld. A copy of that W-2G is sent to the Internal Revenue Service. You must report all gambling winnings as "Other Income" on Form 1040 or Form 1040-SR, including winnings that aren't reported on a W-2G. When you have gambling winnings, you may also be required to pay an estimated tax on that additional income.

    If your winnings were non-cash prizes, such as an automobile or vacation trip, the IRS instructs you to report the fair market value of each prize. Non-residents with winnings at Michigan casinos or racetracks are still subject to Michigan state tax.

    Who do the taxes get paid to?

    The payor of gambling winnings is required to file Forms W2-G with the IRS by the last day of February of the year following the year of prize award. Form 1096, "Annual Summary, and Transmittal of U.S. Information Return," is used to transmit the Forms W2-G to the IRS. Forms are only filed with the Michigan Department of Treasury when withholding is required.

    Reporting the Federal Tax

    Form 945, "Annual Return of Withheld Federal Income Tax," is used to report and pay the monies withheld to the IRS. Form 945 is an annual return and is due January 31 of the year following the year in which the taxes are withheld. Be sure to mark the Form 945 checkbox on Form 8109, Federal Tax Deposit coupon.

    The federal employer identification number (FEIN or EIN) of the organization conducting the raffle is required to be listed on the Forms W2-G, 1096, and 945. If you have not secured an EIN, you may apply for one on the Form SS-4, "Application for Employer Identification Number," available from the IRS.

    How do they get used?

    You may deduct gambling losses only if you itemize your deductions on (Form 1040) and keep a record of your winnings and losses. The amount of losses you deduct can't be more than the amount of gambling income you reported on your return. Claim your gambling losses up to the amount of winnings, as "Other Itemized Deductions."

    So if you had $4,000 in winnings and $10,000 in losses last year, your deduction would be limited to $4,000. The remaining $6,000 cannot be carried over.

    The IRS may request that you substantiate gambling wins and losses.

    Your documentation may include:

    • Form(s) W-2G.
    • Form 5754 (group gambling winnings)
    • Wagering tickets with dates, locations, and amounts won/lost. Also provide names of anyone who gambled with you, if applicable.
    • Canceled checks or credit records.
    • Financial and bank statements.

    Sports betting winnings are taxable income.

    The IRS states:

    “Gambling winnings are fully taxable and you must report the income on your tax return. Gambling income includes but isn’t limited to winnings from lotteries, raffles, horse races, and casinos. It includes cash winnings and the fair market value of prizes, such as cars and trips.”

    Even though sports betting isn’t specifically listed, it falls under the umbrella of “gambling winnings.”Wherever your sports betting win occurred – at the OTB, the casino, on a sports betting app – the payor should send Form W-2G.

    Sports betting losses might also be used as deductions if you itemize your deductions and keep a detailed record of wins and losses.

    Based on your tax bracket, sports bettors in Pennsylvania could owe up to 35% of winnings to the federal government in addition to the 3.07% Pennsylvania taxes net gambling winnings.
